Abstract A szerző hiánypótló tanulmányában egy olyan fogalom definiálására tesz kísérletet, amelyet a magánélet védelmével foglalkozó szakemberek használnak ugyan, ám eltérő tartalommal, és sokszor bocsánatot kérve azért, hogy magyar nyelven képtelenek egészen pontosan kifejezni azt, amire gondolnak. Ez a privacy fogalma. A szerző arra mutat rá, hogy a privacy definíciói feleslegesen leszűkítik e fogalom tartalmát, és megkísérli magyar nyelven, a magyar jogrendszer fogalmait használva megadni a meghatározást. A szerző felvázolja a magyar alkotmányban nevesített szabadságjogok és a korábban definiált privacy kapcsolatát, rámutat a nevesített jogok és a privacy vonatkozásában meglevő átfedésekre, végül pedig azt elemzi, hogy milyen viszonyban van egymással a magánszféra védelme és az adatvédelem.
Abstract (translation) The author of this study attempts to fill a deficiency by defining in Hungarian the term of privacy. Although experts on the protection of privacy do use this English term, they do so with a varying meaning and frequently apologize for being unable to express exactly what they mean in the Hungarian language. The author points out that existing definitions of privacy unnecessarily narrow down the concept, and attempts to supply a definition in Hungarian, using the terminology of Hungarian law. He also sketches the connections between the freedoms ser forth in the Hungarian Constitution and the concept of privacy as defined earlier, then points out where the definitions of the freedoms and those of privacy overlap, and finally analyzes the relationship between privacy protection and data protection.
