Abstract A szerzők a magánszférához való jog jogrendszerbeli elhelyezésére tesznek kísérletet. Warren és Brandeis cikke az első ebben a tárgyban született jogtudományi tanulmány, publikálására 1890-ben került sor. Az angolszász jog common law rendszerében a magánszférához való jog elismerésére tett javaslatuk a magánszféráról alkotott jogelmélet alapját képezi. A magánszférához való jogot úgy definiálják, mint azt a jogot, hogy az ember egyedül lehessen. Első ízben kerül magyarul az olvasó kezébe a magánszférához való jog diskurzus- megalapozó klasszikusa.
Abstract (translation) The authors attempt to locate the right to privacy in the common law system. This article by Warren and Brandeis is the very first legal treatise on this subject, published in 1890. Their proposal to recognize the right to privacy based on the English common law continues to provide the basis for contemporary jurisprudence dealing with privacy. The right to privacy is defined by the authors as the right of an individual to be let alone. This fundamental classic of the legal discourse on privacy is now made available for the first time in Hungarian.
